Falta de Ética y Valores en Agencias Inmobiliarias en Bávaro - Punta Cana.

La falta de Ética, Valores personales y profesionales en el sector de Agencias Inmobiliarias en Bávaro-Punta Cana está siendo un grave problema para el próspero desarrollo del sector, debido a los miles de clientes que han sido ya engañados en el proceso de compra-venta de una propiedad.

Muchas veces, el "Agente" trabaja para las dos partes- vendedores y compradores- y se dan casos en los cuales no informa de cosas negativas y a veces fraudulentas, relacionadas con la propiedad en venta ocultando al comprador dicha información vital. Por otra parte, otro problema se traduce en inflar el precio de la propiedad; hay muchos "Agentes" que se dedican a presentar a sus clientes precios de propiedades más elevados que el precio real de venta, para así ganar una mayor comisión de venta- muchas veces porque hay una cadena de referidores implicados y otras veces simplemente por la desesperación de obtener dinero, cuanto más mejor-.

Este comportamiento es totalmente anti-ético y anti-moral, y solamente beneficioso para dichos "Agentes". De esta manera, tanto compradores como vendedores sufren pérdida de poder adquisitivo, es decir, dinero; asimismo ello causa un cuadro de estrés y por consiguiente un daño gravísimo al mercado de inversores y repercute en la reputación del sector inmobiliario de Bávaro – Punta Cana.

Me pregunto a nivel personal estas dudas:

Qué cualificaciones deberían tener los Agentes inmobiliarios?
Hay un mínimo requisito académico y profesional para los trabajadores del sector inmobiliario?
Esos trabajadores, tienen cualificaciones de Agencia inmobiliaria que avalen su trabajo, tienen de experiencia en el sector, o tienen un mínimo de sentido común?
Por qué no hay una comprobación de antecedentes criminales personales de dichos agentes, especialmente para aquellos que los tienen por extorsión?

Hay una gran diferencia, entre lo que es ético a nivel de estándares de trabajo y lo que muchos agentes y agencias utilizan a su criterio y entienden como legal debido a que no hay regulación inmobiliaria en la República Dominicana, sino un ante proyecto de ley todavía pendiente desde hace años. Tanto el Gobierno como sus respectivas oficinas de Defensa al Consumidor saben de esta situación, pero no ponen ningún remedio para terminar con esta situación de indefensión total del Sector Inmobiliario.

La Asociación de Empresas Inmobiliarias-AEI- en Bávaro, no han conseguido nada positivo en su desarrollo desde su creación, debido a que ha sido dirigida por personas y "agentes" locales sin experiencia, sin cualidades de dirección y liderazgo- muchos de ellos con una mala y pobre reputación, mala dirección de empresa en términos de personal, compra y venta de propiedades-, sin olvidarnos de que muchos de ellos tienen casos jurídicos inmobiliarios abiertos, y permiten que personas no éticas, sean asociados de la misma, sin cumplir ningún criterio ni por consiguiente cumplir los estatutos aprobados.

Estas Asociaciones de Agencias Inmobiliarias, ofrecen sus servicios y registran a personas físicas y jurídicas como asociados a cualquiera que a su vez no aporte nada a la Asociación si bien, siguen utilizando el nombre de la misma, además de que sus dirigentes la utilizan exclusivamente para su propio bien, beneficio personal y profesional promocionando su propia agencia, generando una información falsa y distorsionada al cliente de la situación actual del mercado inmobiliario.

Exigir un comportamiento Ético, es una obligación de cualquier empresa y cualquier trabajador, independientemente del sector en que se trabaje, del país de procedencia, o para quién se trabaje. Para ser exitoso en el sector inmobiliario, la clave está en basarse en la ética profesional y personal de cada persona, y de su negocio trasladándolo a los clientes. La Ética está ligada a la moral de cada persona y a su percepción sobre lo que está bien y lo que está mal.Ser ético en la vida personal y profesional, no es un concepto nuevo sino que se remonta a la época de Roma, donde el filósofo Cirilo, ya definía el éxito como aquella persona que entendía de buena ética y moral tanto de pensamiento como de acción.

El problema, radica en que a primera vista no se sabe quién es o no ético, pero cuando se necesita el dinero desesperadamente o se va a cobrar menos dinero que el deseado en una comisión, entonces aquellos "Agentes" se vuelven más agresivos siendo anti-éticos. Hoy habitualmente, muchos "Agentes" solo viven de las apariencias, aunque ese camino anti profesional que recorren les pasa factura a muy corto plazo.

Sin embargo, la Ética no solo se traslada a los agentes, sino también a los propietarios de las propiedades. Por desgracia, no podemos convencer ni forzar a nadie a ser Ético. La importancia de la Ética en los negocios, es vital para obtener confianza en las relaciones y contactos con clientes y propietarios, ´es decir, para conseguir éxito profesional y personal. Muy pocos vendedores o compradores, quieren trabajar con agencias inmobiliarias que no le dan confianza y que tengan un comportamiento no ético, precisamente ser ético elimina el miedo de la desconfianza, siendo una estrategia siempre beneficiosa para ambas partes.

Me permito redactar en unas líneas mi experiencia vivida como inversor privado en la República Dominicana, concretamente en Bávaro-Punta Cana.

La primera razón, la cantidad de personas que ofertan servicios inmobiliarios o de bienes raíces siendo personas no profesionales del medio y obviamente no cualificadas para tal fin.

La segunda, que dichas personas no tienen un domicilio social ni físico, es decir, carecen de oficinas donde desempeñar su trabajo porque simplemente no son empresas legales.

La tercera, cualquier persona, y reitero cualquiera, puede venderte o alquilarte lo que sea con total normalidad utilizando engaños y mentiras.

La cuarta, muchas personas, es decir la mayoría, ofrecen propiedades sin título lo que repercute en gastos en el futuro a corto, medio y largo plazo del comprador o cliente.

La quinta, en cuanto al mal estado de conservación de las propiedades en consecuencia por la falta de interés y no existencia de mantenimiento preventivo.

La sexta, los problemas generados de aquellas personas físicas o jurídicas, es decir el común ciudadano de a pie, e incluso de otros locales comerciales con actividades diferentes a la actividad inmobiliaria o de bienes raíces que se encargan de administrar condominios y plazas a través de una administración inadecuada, ineficaz e ineficiente.

La séptima, aquellas agencias inmobiliarias o bienes raíces, y aquellos vendedores que con mala fe e intención de lucrarse no legalizan los contratos ante notario ni ante abogados colegiados, y que presentan credenciales o licencias de agencia inmobiliaria de otros países concretamente de Estados Unidos ya expiradas y no válidas aquí en la Republica Dominicana.

La octava, aquellos Abogados que se dedican a negocios diferentes a su naturaleza jurídica de la abogacía, es decir, a ser puramente vendedores inmobiliarios sin experiencia ni conocimientos, faltando a los valores, a la ética y a la profesionalidad de las propias empresas Inmobiliarias creando una competencia desleal, una ruptura en los precios, y una economía sumergida de mercado no declarando ni pagando impuestos.

La novena, el sistema de Comisiones, es decir, toda actividad inmobiliaria entendida de principio a fin, conlleva inseparablemente las comisiones de diferentes personas incluso sin conocer ni trabajar con el cliente, desde que aterrizas en el aeropuerto de Punta Cana.

La décima, es la impunidad legislativa y judicial en el sentido amplio del concepto de intrusismo por daños y perjuicios derivados de tales mecanismos y modus operandi dentro la práctica libre y no regulada del sistema inmobiliario de bienes raíces dominicano basado exclusivamente en ganar e incluso obtener dinero de una manera ilícita y rápida.

Como conclusión, y opinión, aconsejo que:

-Nunca compren o alquilen una Propiedad de un vendedor que a su vez no represente a una empresa Inmobiliaria legalizada con su Registro Nacional de Contribuyentes RNC y con su correspondiente Domicilio Social de oficina.

-Nunca compren una propiedad sin Títulos.

-Nunca te obliguen a trabajar con un determinado Abogado.

-Nunca compren a un Vendedor que quiera cobrar una comisión superior en concepto a alquiler de 1mes de comisión por 1 año de contrato, o ½ mes de comisión por 6 meses de contrato, así como una comisión superior al 5 % en caso de una operación de venta.

Hoy, estamos obligados a solicitar y exigir una Ley de Empresas Inmobiliarias inmediata, puesta en práctica que ayude a proteger las inversiones presentes, y futuras para así evitar está situación de indefensión, engaño, y deterioro de imagen que está afectando al mercado inmobiliario diariamente, a los clientes, a los constructores , y por consiguiente que garantice las futuras inversiones del país como base esencial del desarrollo próspero e innovador de la Rep.Dominicana.

Lack of ethics from Real Estate Agents in Bavaro - Punta Cana.

The lack of ethics in the real estate business of Bavaro - Punta Cana, is a matter of great concern, as thousands of consumers are being ripped-off in the process of buying or selling a property.

Many times, the Agent works for both parties -the buyers and the sellers- and do not disclose negative –and sometimes fraudulent- information to the opposite party about the property they are selling. The practice of inflating apartment prices is also a problem; some agents submit offers to buyers, which are higher than the actual price in order to gain higher compensation- many times this is due to the chain of referrals or just desperation to make a quick buck now.

This misconduct is unethical and is profitable only for the agent. Both the buyers and the sellers suffer a financial loss, not to mention the emotional distress caused by such unethical acts, also devastating to the market and the reputation of the Bavaro – Punta Cana Real Estate business.

"What qualifications should real estate agents have?

· Is there a minimum academic or professional requirement for those employed within this industry?

· Do these employees hold academic or professional real estate certification to warrant their practice, or even just a minimum of business experience or common sense?

· What about negative criminal backgrounds?

There is a big difference between what is legal and what is ethical and many agents use ‘legal’ instead of ‘ethical’ standards, since there is no law that regulates Real Estate Agents in the Dominican Republic. The Government and consumer protection bodies, although aware of the rot in the industry, do not do anything to put an end to the situation.

Real Estate Associations have generally failed in its mandate, having been established by local agents with no experience or leadership skills- many with a poor reputation, poor management and/or selling record, and many in the middle of legal issues related to real estate. These “Associations” offer registration for people who seek to practice as Real Estate agents, but offer no real incentive of benefits to belong to the Association, while its governing members use it solely for self-promoting of their services. These conditions may lead agents to provide false or misleading information.

Demanding ethical behavior from people is not a big ask, regardless of which industry you work in, what walk of life you come from, or who you work for or with. In order to be successful in real estate, how you conduct yourself and your business must be based on ethics.

Ethics are linked to a person’s morals and a person’s perceptions of what is right and wrong and good or bad. Being ethical, and ultimately being successful in business, isn’t a new concept either. Dating back to Ancient Rome, philosopher and statesman Cicero encouraged business people to revise their thinking and believed that real success comes from not from trickery and deception, but from moral goodness, in both thought and action.

The problem is, you often can’t tell at first who is and who isn’t lacking in ethics. If somebody feels like they're going to make less money, they find ways to cut corners or be more aggressive in a way that's not necessarily ethical. Often, deceitful agents look just like the honest ones on the surface and are often charming, considerate and knowledgeable. But bad behavior in business has a tendency to come back to bite you on the behind, and when it comes to real estate, it’s imperative that real estate agents stop thinking about who is right and start thinking about what is right.

However, not all agents follow such practices; a generalization for unethical practices of agents would be unfair. In the real estate business ethics are not just about the agents, it's also about the property owners.

Sadly you can’t force people to be ethical. The importance of ethics is vital in building trust in relationships. Very few vendors or buyers want to work with a real estate agent they don’t feel they can trust, and ethical behavior eliminates that fear. In this sense, a strong show of ethics can be one of your most profitable strategies.

Where do you live? I live the Friusa area near Bavaro.

Do you have a fixed leisure / work routine? What does it look like? I try to keep a fixed work routine, with a set office hour of 9am to 6pm, sometimes later, from Monday through Saturdays. As far as leisure, I do not have a set routine, sometimes I visit different beaches in the area, sometimes home with friends sharing nice meal by the pool.

How many hours do you work per week? I usually work about 36 hours a week.

Why did you branch out on your own, how did you do it? I decided to work independently, firstly because the contract with the company where I worked for the first two years came to an end, and second, simply to be able to work for myself.

What would you say is the biggest reason for your success in Bavaro? I would say a big factor is my perseverance, professionalism, honesty and the personalized attention along with great service that I offer to all that visit my office.

If you could go back in time, what would you do differently? If I could go back in time, I think it would take a couple of opportunities that arose and for different reasons did not, but I am happy to have by office and I am thankful to the support of my repeat clients.

Tell us a little bit about Isabelle Chanteperdrix.

I’m from Lyon, France. I came here in 2006 on vacation and fell in love with the island. I knew right away that this was where I wanted to be. Two years later I closed my hair salon in Lyon and moved to Paradise.

Where do you live?

I was looking for a nice place that was walking distance to the beach. I contacted Punta Cana Lifestyle Real Estate, and they found me a wonderful, spacious, one bedroom apartment located in the Cortecito area with a large, private terrace on the level above. I really love it, I can walk to the beach and am very close to all the area shops and restaurants.

Do you have a fixed leisure / work routine? What does it look like?

I spend a lot of time at the beach and having dinner with friends, I love to cook. There is a nice sized French speaking community here, sometimes we get together at one of the many area restaurants for dinner and drinks.

On my time off, I also like to get away and visit some of the island’s beautiful spots like Saona Island, Catalina Island, and other surrounding towns. The local beach here, Bavaro Beach, is one of most beautiful beaches I have ever seen. It has white sands and crystal clear waters, just an amazing place to live.

I have a set schedule for work and I try to take advantage of every minute I have to myself.

How many hours do you work per week?

My shop is open Monday through Saturdays from 9:30am to 6:00pm

Why did you branch out on your own, how did you do it?

I felt I had something else to offer my clients; I wanted a salon that focused on great service and atmosphere –and most importantly, a good product!

I contacted Punta Cana Lifestyle Real Estate and I asked for help in finding the ideal place for my new salon. I had in mind something small, and cozy to maintain a nice ambiance, the price was a big factor, and of course a great location with good street exposure.

Punta Cana Lifestyle Real Estate had helped me in the past with my living arrangements, so I counted on them to help me get started. We found a nice space at Plaza Sun Beach, with 32m2, lots of light and great street exposure. I am very happy where I am.

What would you say is the biggest reason for your success in Bavaro?

Bavaro – Punta Cana has a big European community, the area salons had no good quality product like the one I am accustomed to using, and there was a huge lack of experience and education about hair care. Most hairstylists have no previous salon experience, studies or its products.

I knew it was time to open my own hair salon when my clientele started asking me to do it. As we all know, going out on your own is risky, but with the ongoing support of my clients, it’s become a great success.

If you could go back in time, what would you do differently?

Nothing, I think I took my time and built my reputation, established myself as a reputable hair stylist.

Thanks very much for sharing with us, have you any plans (personal or business) that you can share with us about your future plans, goals, lifetime goals?

I travel to France with frequency, and I am now beginning to bring in accessories that include hand bags and custom jewelry, to sell at my shop. I hope to expand my business in the future to a larger place to accommodate these great accessories.

The Dominican Republic with its numerous resources, is well positioned as an ideal place for foreigners wishing to purchase property, work, , invest, and retirement destination. Whether you are looking to invest or just relocate, the Dominican Republic offers different types of residency options to meet your needs.

Once you obtain your Dominican Residency, whether it is temporary or permanent, you immediately acquire a number of benefits granted by the Dominican Republic, which include major incentives which include the following:

Customs tax exemption on home furnishings and personal property that includes appliances, furniture, etc… if owned at least one (1) year previous to importing these items;
No longer required to pay for a tourist card upon entering the country;
You are able to work legally in any company in the country;
You will have completed the first step to obtain your Dominican citizenship, if interested.

One of the best and recent developments in the Dominican Republic in foreign investment has been the creation and publication of the Law on Special Incentives for Foreign Pensioners and Annuitants (Law 171-07). Foreign retirees and annuitants, who wish to reside in the Dominican Republic and enjoy their pension from abroad, can apply for benefits and incentives granted by the law indicated.

To do this, pensioners must receive a monthly income of not less than One Thousand Five Hundred U.S. Dollars (U.S. $ 1,500.00), and the Annuitant shall receive a monthly sum for Two Thousand Dollars (U.S. $ 2,000.00) or its equivalent in local currency .

-The exemptions and benefits in the legislation referred to above include:

Exemption from taxes on home furnishings and personal property (Law 143-93) .
Partial Tax Exemption of motor vehicles (Act 168, amended by Law 146-00) .
Exemption from transfer taxes on real estate transfers for the first property acquired;
Exemption from taxes on the payment of dividends and interest generated in the country or abroad;
50% exemption of taxes on mortgages, financial institutions regulated by the Monetary and Financial Law, acting as creditor;
50% exemption of tax on property, where it applies, and
50% exemption of capital gains tax when the Pensioner or Annuitant is the senior partner in the society.
